Color Health Sweepstakes: Official Rules

V
Written by Vee Garcillano

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID IN WISCONSIN AND WHERE PROHIBITED.

  1. Sponsor. Color Health, Inc., 365 Oyster Point Blvd., Suite 300-3A, South San Francisco, CA 94080 (“Color,” “we,” or “us”).

  2. How These Rules Work.

    1. These Official Rules apply to every Color sweepstakes that links to this page (each, a “Sweepstakes”). Color announces each Sweepstakes in an email, mailer, poster, or other communication (a “Promotion Communication”). Each Promotion Communication will state these details for its Sweepstakes (the “Promotion Details”):

      1. the Sweepstakes name;

      2. the entry period, including start and end dates, times, and time zone;

      3. the eligible activity;

      4. any program eligibility requirement;

      5. each prize, the number of prizes, and the approximate retail value; and

      6. the drawing date.

    2. The Promotion Details are part of these rules for that Sweepstakes. If the Promotion Details conflict with these rules, the Promotion Details control, but only for the items listed above. These rules control on everything else. By entering, you agree to these rules and to Color’s decisions, which are final.

  3. Who Can Enter.

    1. You can enter if you are:

      1. a legal resident of the 50 United States or D.C., excluding Wisconsin;

      2. 18 or older and at least the age of majority in your state when you enter; and

      3. eligible for Color services through a participating program, if the Promotion Details say so.

    2. You cannot enter if you are a Color employee, contractor, director, or officer. The same applies to their immediate family members and household members, and to employees of Color’s agencies and prize suppliers.

  4. Entry Period. Each Sweepstakes runs during the entry period stated in its Promotion Details. An entry counts only if Color’s systems receive it before the entry period ends. If there is a question about timing, the time Color’s systems record the entry decides whether it was on time.

  5. How to Enter. Complete the eligible activity stated in the Promotion Details during the entry period. You get one entry per Sweepstakes. Entries made with multiple identities, multiple email addresses, or automated tools are void. If there is a dispute about who made an entry, the entry belongs to the authorized holder of the email address used. f the eligible activity asks about your family health history, you do not have to answer those questions to enter. Instead, complete the rest of the activity and email support@color.com during the entry period with your name, the email address on your Color account, and the Sweepstakes name. Do not include any health information in your email.

  6. About the Eligible Activity. Color health activities, such as a cancer risk assessment, are at no cost to you and part of the health services Color already offers. They have health value on their own. Completing one does not require any purchase or payment from you. Choosing not to complete an activity does not affect your access to Color services.

  7. Prizes. Each prize, its number, and its approximate retail value (“ARV”) are listed in the Promotion Details. The total ARV of all prizes in a single Sweepstakes will not exceed $5,000. You can win only one prize per Sweepstakes. You cannot transfer a prize or exchange it for cash. Color will substitute a prize of equal or greater value only if the listed prize becomes unavailable.

  8. Winner Selection and Notice. Within the time stated in the Promotion Details, Color will select winners in a random drawing from all eligible entries. Odds of winning depend on the number of eligible entries received. Potential winners will be notified by email or phone. Each must respond within 7 days and may need to sign a short eligibility and release form. If a potential winner does not respond, is ineligible, or does not return the form, Color will draw an alternate. Color will keep drawing until all prizes are awarded.

  9. Prize Delivery and Taxes. After a winner is confirmed, Color will deliver the prize free of charge within 10 days. Winners pay any taxes on their prize. For prizes worth $600 or more, Color will request a Form W-9 and issue a Form 1099.

  10. Privacy and Your Health Information. Color handles entry information under its Privacy Policy at [Color privacy policy URL] and, where it applies, its Notice of Privacy Practices. Color runs drawings without using your name or health details, and links an entry to a person only to contact a selected winner. Color will not share individual entry or activity information with your employer or health plan.

  11. No Public Announcement Without Your Permission. Color will not use a winner’s name, image, or story publicly unless the winner signs a separate, voluntary authorization. Saying no does not affect the prize.

  12. Fair Play. Color may disqualify anyone who tampers with entries, breaks these rules, or interferes with the Sweepstakes.

  13. Changes and Cancellation. If fraud, a technical failure, or an event beyond Color’s control prevents a Sweepstakes from running as planned, Color may change, suspend, or end it. If Color ends a Sweepstakes early, it will draw winners from the eligible entries received up to that point.

  14. Release and Limits on Liability. By entering, you release Color, its affiliates, agencies, and prize suppliers from claims related to the Sweepstakes or to the use of any prize, as far as the law allows. Color is not responsible for entries that are late, lost, or incomplete, or for technical problems. Some states do not allow these limits, so they may not fully apply to you.

  15. Governing Law. California law governs these rules. Any dispute must be brought in the state or federal courts in San Mateo County, California.

  16. Winners List and Rules Requests. To ask for a winners list or a copy of these rules, email [support email] with the Sweepstakes name. You can also mail a self-addressed, stamped envelope to the Sponsor address above. Vermont residents may omit postage. Requests must arrive within 4 weeks after the Entry Period ends.
